Take the Fifth

New York 증권거래소의 Chairman 이었던 Richard Grasso 가 약 1500 억원 정도의 분에 넘치는 보수를 부당하게 받았다고 하여서 2003년 자리에서 물러났다. 그 이후 계속적으로 SEC (US Securities and Exchange Commission, 미국 증권 감독원) 의 조사를 받고 있는 Grasso 에 관한 뉴스가 CNBC 라는 방송국의 프로그램에 소개되고 있다.

Invoke (또는 Take) the 5th 는 미국의 수정헌법 제5조에 명시되어 있는 묵비권과 일사부재리 (Double jeorpardy) 원칙중에서 묵비권을 행사하다는 뜻이다. 증권 감독원의 조사중에서 Dick Grasso 가 자기 자신에게 불리한 증언을 거부할 수 있는 수정헌법 제5조에 의거하여 168 번이나 심문에 대답하지 아니하였다는 것이다.

Michelle Wie 가 2004 년 CBS 의 인기 시사 프로그램인 60 Minutes 에 나와 기자인 Steve Kroft 와 나누었던 대화이다. 당시 14 살의 어린 나이인 Michelle Wie 는 push the envelope 을 이해하지 못하여서 그녀가 한 어린 소녀에 불과하다는 것이 더욱 부각된 프로그램이었다.

push the envelope 의 envelope 은 봉투가 아니라 “우리에게 통상적으로 주어진 어떤 능력의 한계를 표시하는 선” 을 뜻한다. 그러므로 이 한계선을 push 하면 “우리에게 일반적으로 주어진 능력의 한계를 극복하여 넓힌다” 는 뜻이 된다.
